Welcome to Nibango. By accessing or using the Nibango mobile application and website (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By registering, you represent that you meet this requirement.

2. Your account

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must provide accurate, current information when creating your account.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately if you suspect unauthorized access.

3. Acceptable use

You agree not to:

  • Post illegal, fraudulent, misleading, or prohibited content.
  • Infringe the intellectual property or privacy rights of others.
  • Harass, threaten, or otherwise abuse other users.
  • Use the Service for money laundering, scams, or any illegal activity.
  • Attempt to access other users' accounts or our systems without authorization.
  • Use bots, scrapers, or automated tools without our express permission.

4. Listings and transactions

  • Nibango is a marketplace platform that connects buyers and sellers. We are not a party to transactions between users.
  • Sellers are solely responsible for the accuracy of their listings and the legality of the items offered.
  • Buyers should exercise due diligence before completing any purchase.
  • We reserve the right to remove listings that violate these Terms or applicable law.

5. Payments and refunds

Using Nibango is free. Some optional extras can be bought in the iOS and Android apps: promotions, which highlight one of your listings for a few days, and adverts, which show your business in the feed. The price is shown before you pay. Payments are processed by Apple (App Store) or Google (Google Play), and their terms also apply. We do not take payments on our website.

  • Promotions start as soon as you pay. By paying, you ask us to start them straight away.
  • Adverts are reviewed by our team before they go live, and the paid days only start when the advert is approved. If we reject an advert, you can edit it and send it again at no extra cost.
  • If we cannot publish your advert at all, or we fail to provide what you paid for, you are entitled to a full refund.
  • How refunds are paid: for purchases made on Android, we refund you through Google Play. For purchases made on iPhone or iPad, Apple handles every refund: you request it at reportaproblem.apple.com and we tell you exactly how.
  • If you are a consumer in the European Union or the United Kingdom, you can cancel within 14 days. If you asked us to start a promotion straight away and cancel during those 14 days, you may be charged for the days already used. This right ends once the promotion has been fully provided.
  • You can also ask Apple or Google directly for a refund under their own policies.

Nothing in these Terms limits the rights you have under the consumer protection laws of your country. For any question about a payment, write to support@nibango.com.

6. Content you post

  • You retain ownership of the content you post (images, descriptions, messages).
  • By posting content, you grant Nibango a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Service.
  • You represent that you have the right to post the content and that it does not violate any third-party rights.

7. Prohibited items

You may not list items that are illegal to sell in your jurisdiction, including but not limited to: weapons, drugs, stolen goods, counterfeit products, hazardous materials, and items that infringe intellectual property rights. 8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Intellectual property

The Service, including its design, logos, and software, is owned by Nibango and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our permission.

10. Termination

  • You may delete your account at any time through the app settings.
  • We may suspend or terminate your account if you violate these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases, but provisions that by nature should survive (e.g., liability, indemnity) will remain in effect.

11. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of any listing or user. We are not responsible for the quality, safety, or legality of items listed.

12. Limitation of liability

To the maximum extent permitted by law, Nibango shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service or any transaction between users.

13. Indemnification

You agree to indemnify and hold Nibango harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Governing law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
